Terms & Conditions

Last Updated: June 2, 2026. Welcome to Apex Web Studio. These terms and conditions govern your relationship with us and describe the rules for our digital product delivery and service agreements.

1. Services & Custom Deliverables

Apex Web Studio provides custom website design, development, and optimization services. Each project is architected based on a mutual kickoff loop where specifications, domains, and timeline estimates are established. Delivery timelines (e.g., 3-day or 5-day delivery) begin once all assets and project descriptions are successfully supplied by the client.

2. Payment Structure & Deposits

Unless otherwise negotiated in writing:

  • 50% Retainer: A 50% upfront deposit is required to kick off project development and secure your development slot.
  • Final Milestone: The remaining 50% balance is due immediately upon client review and approval of the completed website before production domain deployment.
  • Payments: Accepted via local bank transfers (NCB, Scotiabank, Sagicor, JN Bank, or Lynk) and secure card processing systems.

3. Intellectual Property Rights

Upon receipt of the final milestone payment, the complete custom codebase, assets, and design ownership of the deliverables are fully transferred to the client. Apex Web Studio retains the right to display the completed work in our online portfolio and case studies for promotional purposes unless explicitly opted out by the client.

4. Hosting & Domain Management

We setup hosting on cloud systems (like Vercel) and connect your custom domain name. While we guarantee clean build architectures, ongoing server uptime and hosting platform behavior are managed by third-party providers (Vercel, domain registrars). Apex Web Studio is not liable for network outages or domain registration lapses caused by those platforms.

5. Limitation of Liability

In no event shall Apex Web Studio, its developers, or representatives be liable for any direct, indirect, or consequential damages (including lost profits or business interruptions) arising out of the use or inability to use the custom website deliverables, even if advised of the possibility of such damages.

6. Governing Law

These terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
